Technical Documentation under the EU AI Act

Technical documentation under the EU AI Act is not a file archive. It is the structured evidence base that allows a high-risk AI system to be classified, reviewed, approved, monitored, and defended. For providers, it is a legal requirement before placing a system on the market. For deployers, it determines whether the system they rely on can be responsibly governed. Without structured technical documentation, governance becomes a collection of documents with no demonstrable connection to the decisions they are supposed to support.

Technical documentation under the EU AI Act is not a file archive. It is the structured evidence base that allows a high-risk AI system to be classified, reviewed, approved, monitored, and defended. For providers, it is a legal requirement before placing a system on the market. For deployers, it determines whether the system they rely on can be responsibly governed. Without structured technical documentation, governance becomes a collection of documents with no demonstrable connection to the decisions they are supposed to support.

Technical documentation is the system’s evidence backbone

A high-risk AI system cannot be governed through a description of its business purpose alone. The organization needs to understand how the system works, what it is intended to do, how it was developed or configured, which data is relevant, which risks were considered, which controls exist, and which instructions define correct use.

Technical documentation creates the backbone for that understanding. It may cover system description, intended purpose, design specifications, development logic, data governance, model information, performance characteristics, risk management, human oversight, technical measures, instructions for use, monitoring logic, and change management. The exact depth depends on the actor role and system context.

A provider carries deeper documentation duties than a deployer. But a deployer cannot govern a high-risk AI system blindly. If it relies on a provider, it still needs enough documentation or instructions to use the system correctly and support its own governance duties.

Why technical documentation must be structured

Many organizations treat technical documentation as a collection of documents: a vendor PDF, a system architecture diagram, a security questionnaire, a product manual, a model card, a privacy note, a technical note from IT. These documents may be useful, but they do not automatically create governance.

Technical documentation becomes useful when it is connected to the AI system, the intended purpose, the risk classification, the actor role, the obligations, the evidence state, the approval path, and the audit trail. A folder full of files is not the same as technical documentation readiness. The governance question is not only whether documentation exists — it is whether the organization can show which documentation supports which decision.

Annex IV is not an abstract checklist

Annex IV describes the content areas that technical documentation must cover for high-risk AI systems. Organizations should not treat it as a static checklist that sits outside the operational workflow. The documentation areas must become part of system governance, helping answer questions such as:

  • What is the AI system and what is its intended purpose?
  • Who provides it and who deploys it?
  • Which model or technical approach is used?
  • Which data is used or relevant?
  • How are outputs produced and interpreted?
  • What level of human oversight is expected?
  • Which risks were assessed and which performance characteristics are known?
  • Which instructions for use apply and which changes require renewed review?
  • Which evidence is missing?

These questions are not academic. They determine whether the system can be governed.

Technical documentation supports risk classification

Risk classification depends on system context. An organization cannot reliably determine whether an AI system is high-risk, limited-risk, or outside a relevant category without understanding how it is intended to be used and what function it performs. Technical documentation supports that determination by showing whether the system influences decisions, whether it is used in a sensitive domain, whether it processes certain data, whether human oversight exists, whether it is embedded in another product, whether it is substantially modified, and whether provider instructions constrain the intended use. A risk class without technical support is difficult to defend.

Technical documentation supports actor role assessment

Actor role assessment also depends on technical and operational facts. An organization may begin as a deployer of a third-party AI system. But if it modifies the system substantially, integrates it into its own product, rebrands it, or controls its intended purpose, the role analysis can change. Technical documentation can show what the organization actually controls — whether the system was configured, modified, fine-tuned, embedded, extended, or merely used under provider instructions. Without technical documentation, actor role assessment may become a legal guess instead of a governed determination.

Technical documentation supports obligation mapping

A high-risk classification is only the beginning. The organization must understand which obligations apply and which evidence supports them. Technical documentation can support multiple obligation areas, including risk management, data governance, transparency, human oversight, accuracy, robustness, cybersecurity, conformity assessment, post-market monitoring, and change management. The Obligation Matrix should not merely state that these areas exist — it should show whether the technical documentation supporting them is complete, partial, missing, external, unclear, outdated, or not applicable.

Technical documentation supports deployer governance

Deployers of high-risk AI systems may not create all technical documentation themselves, but they still need documentation that supports responsible use. This may include instructions for use, limitations, intended purpose, human oversight requirements, input data expectations, logging or monitoring guidance, provider updates, and incident-related information.

A deployer that cannot access or document relevant provider information may struggle to prove that it used the system appropriately. Vendor documentation therefore becomes part of deployer evidence readiness. The organization should not assume that “the provider has the documentation” is enough. It must know which provider documentation it has, what it supports, what remains missing, and how it affects approval.

Technical documentation must remain current

Technical documentation is not a one-time artifact. AI systems change: providers update models, configurations change, data changes, human oversight procedures change, use cases expand, vendor instructions are updated, new guidance becomes available. A technical document that was accurate at first approval may become outdated later. This is why technical documentation must be connected to re-screening and change governance. The organization should be able to identify when technical documentation no longer matches the system being used.

Missing technical documentation is a governance signal

Missing technical documentation should not be hidden — it should be visible as an evidence gap. If the organization lacks provider documentation, this should be recorded. If model or data information is unavailable, this should be visible. If human oversight instructions are unclear, this should trigger completion or review. If cybersecurity evidence is missing, this should affect approval readiness. A missing documentation item is not merely an administrative issue. It may affect risk classification, obligations, approval, audit readiness, and future re-screening.

Why spreadsheets fail technical documentation governance

Spreadsheets can link to technical files. But they cannot reliably show which obligation a document supports, whether it is current, who reviewed it, whether it matches the current system, whether it came from the provider, whether it is sufficient for approval, or whether it requires re-screening after a change. Technical documentation requires structured relationships: system, actor role, risk classification, obligations, evidence, owner, approval, and change history must remain connected. A spreadsheet can store a link. It cannot reliably govern the evidence chain.
