The EU AI Act focuses on AI systems, risk classification, actor roles, obligations, transparency, human oversight, technical documentation, and governance of AI-related risks. The GDPR focuses on personal data processing, lawful basis, data subject rights, processing records, DPIA logic, technical and organizational measures, processors, vendors, and accountability.
In practice, these two governance domains often meet in the same system. An AI system used in HR, customer service, fraud detection, marketing, healthcare, education, analytics, productivity monitoring, or recruitment may create both AI Act relevance and GDPR relevance at the same time. When these domains are managed separately, governance becomes fragmented — and both records become weaker as a result.
AI systems can also be processing activities
Many AI systems process personal data — employee data, customer data, applicant data, patient data, user interaction data, behavioral data, communication data, or transaction data. When personal data is involved, the AI system is not only an AI governance object. It may also be part of one or more processing activities under GDPR logic.
This creates an operational requirement: the organization should be able to show how the AI System Registry connects to the Record of Processing Activities. Without this connection, governance becomes fragmented. The AI governance team may know that a system exists. The data protection team may know that a processing activity exists. But neither side may have the complete picture — and the organization cannot reliably govern what it cannot see in full.
Why AI Act and GDPR silos are dangerous
Silos create blind spots. An AI Act record may classify the system, identify obligations, and document AI governance status — but if personal data is processed, the record may not be complete without data protection context. A GDPR processing record may describe purpose, data categories, recipients, retention, and lawful basis — but if the processing activity involves AI, the record may not be complete without AI system context.
The danger is not only duplication. The danger is inconsistency. One record may say no sensitive data is involved; another may show special-category data. One record may say the system is not high-risk; another may show that it affects employment or access to services. One record may identify a vendor; another may lack the corresponding processor or supplier governance. When governance is split across disconnected records, the organization cannot reliably defend the whole decision.
The AI System Registry and RoPA must speak to each other
The AI System Registry answers the AI governance question: which AI systems exist, who owns them, how are they classified, which obligations apply? The Record of Processing Activities answers the data protection question: which processing activities exist, for what purpose, under which lawful basis, with which data categories, processors, retention periods, and safeguards?
When an AI system processes personal data, these two records should not remain disconnected. The AI system record should be able to reference relevant processing activities. The processing activity should identify AI involvement. This creates a more reliable governance view — the organization can see not only that an AI system exists, but what personal data it processes and under which privacy governance logic.
DPIA and AI governance should not be disconnected
A Data Protection Impact Assessment becomes relevant where processing is likely to result in high risk to the rights and freedoms of natural persons. AI systems can create exactly the kinds of questions that require careful data protection assessment: Does the system evaluate persons? Does it support decisions about individuals? Does it process sensitive data? Does it involve systematic monitoring? Does it affect employees, applicants, customers, patients, or vulnerable groups? Does it use profiling?
These questions overlap with AI Act risk logic. A DPIA may identify privacy risks, mitigation measures, and safeguards. The AI governance record may identify AI risk classification, obligations, evidence, and human oversight. If these records are disconnected, the organization may lose the relationship between privacy risk and AI governance risk. A mature governance process connects them.
TOMs are evidence for AI governance
Technical and organizational measures are not only GDPR artifacts. They can also become evidence in AI governance. Access control, logging, encryption, data minimization, retention controls, incident handling, backup, supplier controls, role management, security policies, and organizational responsibilities may all support the AI governance record.
If TOMs are documented only inside the GDPR module and not connected to the AI system record, the AI governance record may appear weaker than it actually is. The problem is not lack of measures — it is lack of connection.
Vendor governance is shared governance
Many AI systems depend on vendors. A provider may supply the AI model. A SaaS vendor may operate the application. A processor may handle personal data. A subprocessor may support infrastructure. For GDPR, vendor governance asks whether the vendor processes personal data, whether a data processing agreement exists, and whether technical and organizational measures are sufficient. For AI governance, vendor governance asks whether the provider supplies adequate system information, instructions, documentation, and risk information.
These are connected questions. The organization should not evaluate the same vendor twice in disconnected silos. It should understand the vendor relationship as part of a broader governance chain — where the same entity can be relevant for both frameworks, assessed through different dimensions but connected in one governance record.
GDPR compliance does not replace AI governance
AI Act compliance does not replace GDPR compliance — and GDPR documentation does not substitute for AI governance. A system can be reviewed under the EU AI Act and still have unresolved GDPR issues. A system may be low-risk from an AI classification perspective but still require a processing record, data minimization review, data subject rights handling, vendor assessment, or DPIA consideration. A RoPA entry may describe personal data processing, but it may not classify the AI system. A TOM profile may describe security measures, but it may not document human oversight or AI-specific obligations.
The goal is not to collapse GDPR into AI compliance or vice versa. The goal is to create linked governance where the same system can be understood across both frameworks — with consistent descriptions, connected evidence, shared vendor context, and a unified decision record.
Re-screening and privacy review
AI systems change. Data processing changes. Vendors change. Use cases change. A system that originally processed no personal data may later process personal data. A system originally used for internal drafting may later be used for customer decisions. A vendor may introduce new AI functionality. A processing activity may require renewed DPIA consideration. This is why AI governance and GDPR governance should both be connected to change review. Compliance is not frozen at first approval.
